Trial Of Western WA Man Accused Of Raping WSU Student Ends With Hung Jury

The trial of a 21 year old man accused of raping a Washington State University student has ended with a hung jury.

Elijah Nivar stood trial for felony rape in Whitman County Superior Court last week.  Nivar is accused of raping a woman inside her Pullman home in May of 2022.  The alleged victim and Nivar had a previous relationship that ended in November of 2020.  Nivar is a former WSU student.  He was initially arrested by Pullman Police in his hometown of Bonney Lake in Western Washington in July of 2022.  Nivar was quickly released on his own recognizance after being brought back to Colfax.

Attorneys argued the case for four days last week.  The jury began deliberations on Thursday night and ended the trial deadlocked on Friday afternoon.

The Whitman County Prosecutor’s Office could retry the case.  Chief Deputy Prosecutor Dan LeBeau says he will decide in the next few weeks if he wants to proceed with the case.
